ROWE, Justice.

The City of Heath, in Rockwall County, appeals from a judgment disannexing five tracts of land. After the governing body of the city failed to act on a properly presented petition to disannex, several voters who signed the petition sought to compel disannexation pursuant to TEX.REV. CIV.STAT.ANN. article 970a § 10 by bringing suit in the district court of Rockwall County.1
