Plaintiff Bruce John Page, Sr., was injured on June 11, 1975 when a trench in which he was working at the Gilbert Lake State Park collapsed and buried him. Defendant and third-party plaintiff La Buzzetta was a subcontractor on the job pursuant to a contract between the State of New York and third-party defendant S & D Construction Company, the general contractor on the job.
