This is a direct appeal by defendant Herbert Douglas, Jr., from his conviction by jury of aggravated battery (K.S.A. 21-3414).

The crime for which defendant stands convicted occurred at about 12:45 a.m. on December 3, 1981. At the pretrial conference conducted December 30, 1981, defendant indicated he would rely on an alibi defense and supplied the names of three witnesses in support of his alibi.
