TIJERINA, Justice.

This is an appeal from a conviction for attempted capital murder. Appellant was found guilty by a jury and his punishment assessed at twelve (12) years' confinement in the Texas Department of Corrections.

The essential facts in the record indicate that Police Officer Walker was pursuing a vehicle as a result of a reported robbery. The officer stopped the vehicle at 115 Saratoga Street, but was shot before he stepped out...
