On January 29, 1982, in Van Buren, Arkansas, the plaintiff's decedent, Johnny Lee Graham, was shot and killed by defendant, Clyde Harvell. On April 1, 1982, the plaintiff, the Special Administratrix of his estate, filed suit in this court under the provisions of Arkansas' Wrongful Death Statute (Ark.Stat.Ann. § 27-906 et seq.).
