Defendants appeal as of right from the trial court's order granting in part and denying in part plaintiffs' motions for summary judgment, pursuant to GCR 1963, 117.2(3). Plaintiffs cross-appeal that portion of the court's order which granted partial summary judgment, pursuant to GCR 1963, 117.2(3), in favor of defendants.1
