SUMMERS, Chief Justice.

This is an appeal from a conviction for attempted murder. After a plea of not guilty, the jury found appellant guilty and assessed his punishment at twelve years confinement in the Texas Department of Corrections.

We affirm.

The record reflects that on the afternoon of May 17, 1979, appellant shot Claude Gabriel, complainant herein, in the neck with a gun, following a scuffle at the 500 block of San Jacinto Street in downtown...
