This is an appeal from a summary judgment denying plaintiff-appellant attorney's fees.

The pertinent facts of this case are as follows:

Plaintiff-appellant, hereinafter referred to as Henley, was employed by a Mr. Lancaster to represent him in an effort to reinstate Social Security and Medicare disability benefits which had been terminated.
