The sole issue raised in this case is whether a land surveyor employed by the sellers of land is liable to the purchasers of the land either in tort for fraud or under G.L.c. 93A, the Consumer Protection Act, for failing to disclose the existence of a seasonal stream and a high water table which increased the cost of constructing a septic tank.
