Plaintiff and defendant were involved in an automobile accident in Fair Haven, Vermont, on December 23, 1977. Plaintiff instituted this action on May 6, 1980, claiming negligence on the part of defendant and seeking to recover for damages to his vehicle. Defendant answered, denying his own negligence, and filed a counterclaim alleging the accident resulted from plaintiff's negligence. Trial was by court on November 5, 1981.
