Defendant, Gary Moore, was charged by grand jury indictment with having committed the crime of forcible rape in violation of LSA-R.S. 14:42.1. Defendant pled not guilty and waived jury trial. After trial by a judge alone, defendant was found guilty of sexual battery in violation of LSA-R.S. 14:43.1 and sentenced to nine and one-half (9½) years at hard labor with credit for time served in custody on this charge from arrest to date of sentence.
