OPINION

KLEINSCHMIDT, Judge.

Roger Master was charged in a 1978 indictment with three counts of first degree rape, two counts of first degree burglary, and one count of lewd and lascivious acts. Jury trial was waived and the matter was submitted to the trial court on the grand jury transcripts, police departmental reports, testimony and argument on various motions, and all documents in the court's file.
