This is a suit for recovery under the Texas Tort Claims Act. Tex.Rev.Civ.Stat. Ann. art. 6252-19. Alicia Salcedo1 sued Dr. Jose Diaz and the El Paso Hospital District to recover damages for the death of her husband, Everado Salcedo.2 The issue before us is whether Mrs. Salcedo has stated a cause of action within the waiver provision of the Act....
