Virginia Trevino brought this suit as a third-party beneficiary on a policy of homeowner's liability insurance issued by Allstate Insurance Company to Patrick Henry. She alleges that she was injured by the negligent horseplay of the insured Henry and that Henry's liability to her has been established by the allowance of her claim in the bankruptcy court.
