LYNCH, J.

The defendant was charged with assault and battery on a police officer, under G.L.c. 265, § 13D, and disturbing the peace, under G.L.c. 272, § 53. He was found guilty by a District Court judge on both complaints and appealed his convictions to a jury of six session of the District Court. In November, 1976, the jury acquitted the officer, and found him guilty of disturbing the peace, for which he was fined $250. After a series of procedural delays...
