The appellant, Darrell Dameron, was convicted in the Circuit Court of McDowell County of the crime of accessory before the fact to the delivery of marijuana. He was sentenced to an indeterminate term of from one to five years in the penitentiary and following the circuit court's denial of his motion to set aside the verdict prosecuted this appeal.
