The plaintiff, who was in the United States Army from 1959 to 1976, filed this action pursuant to the Federal Tort Claims Act (FTCA), 28 U.S.C. §§ 1346(b), 2671 et seq., and the First, Fourth, Fifth, Eighth, and Ninth Amendments to the Constitution of the United States.
