In this action the defendant has moved for a new trial and has also moved, pursuant to Rule 35, Federal Rules of Criminal Procedure, to have his sentence modified. The motion for a new trial by the defendant, Stan Carlin, is his most recent in a long series of attempts to avoid this court's judgment and sentence which was entered on October 30, 1979.
