This is an appeal from a judgment of conviction for first degree murder. We reverse and remand.

On the evening of January 24, 1981, William Caffrey was shot to death in his home in Martin, South Dakota. His adopted Indian son, the appellant, Timothy Caffrey, who was then seventeen years old, was taken into custody by the sheriff's department a few hours after the incident.
