Appellant was indicted for the capital offense of murder during a robbery in the first degree in violation of § 13A-5-40(a)(2), Code of Alabama 1975. After the jury returned a verdict of guilty, the trial court followed the jury's recommendation and sentenced appellant to life imprisonment without parole.
