This is an appeal by Simmerman, the lessee and operator of a Shell oil station, formerly located at Windy Hill Road and I-75 at Atlanta, and condemned by the Department of Transportation (DOT) for expansion of the expressway. DOT valued the property at $369,565 and paid this amount into the court registry. Eventually Shell decided it was satisfied with this amount as just and adequate compensation and moved the court to disburse the funds to Shell...
