The indictment upon which defendant's conviction for first degree sexual offense was based charged that on or about 15 May 1982, in Buncombe County, the defendant did "commit a sexual offense with Johnny Lamar Guess, a child of the age of 12 or less, the defendant being at least 4 years older than this child...
