Defendant, Darrell Glenn Blackford, appeals from judgment imposed upon his conviction of the offense of sexual abuse in the third degree in violation of Iowa Code section 709.4(1) (1981). He contends on appeal that the trial court erred in excluding material testimony of the victim's husband on the ground of marital privilege and in failing to require a finding of criminal intent in its marshalling instruction...
