This case presents the issue of whether a union's financing of a legal challenge to the employer's affirmative action program violates the union's duty to represent fairly all of its members. The trial court held that petitioners had failed to establish a breach of the union's duty of fair representation. The Court of Appeals affirmed. Allen v.
