On July 30, 1982, defendant, Daniel Eugene Pelkey, was convicted by an Oakland County Circuit Court jury of possession of stolen property over $100, MCL 750.535; MSA 28.803. After being sentenced to not less than 40 months nor more than five years in prison, defendant appeals as of right.
