Rudolph John Pennucci was convicted of murdering JoAnn Richards, his ex-wife, and was sentenced to life imprisonment. The evidence was that on March 22, 1982, the appellant entered the Delchamps Food Store at K-Mart Plaza, Highway 90 in Mobile, where his ex-wife was a cashier.
