During the early evening of September 17, 1980, Charles "Ricky" Talbert was shot by an assailant who wielded a sawed-off shotgun. Eyewitnesses made a photographic identification of the defendant as the assailant, and as a result, on September 22, 1980, he was charged with assault and battery by means of a dangerous weapon.
