The instant matter is before the court on defendant's motion for summary judgment with respect to plaintiff's complaint for no-fault benefits. Since the parties have agreed on all the material facts and since plaintiff's complaint stands or falls solely on the proper interpretation of a statute, the matter is clearly ripe for summary judgment. See, Pa. R.C.P. 1035.
