This is an appeal from an order dismissing petitioner's amended petition for post-conviction relief. We affirm.

Petitioner was charged with first degree burglary based upon an incident that occurred in Minnehaha County on or about November 24, 1978, shortly after petitioner's discharge from the South Dakota Penitentiary on a prior felony conviction.
