Acting as an independent insurance agent, appellant Dillard obtained for appellee Graham Woodall a homeowner's insurance policy issued by Insurance Company of North America. The insured dwelling burned while the policy was in force, but the insurer subsequently refused to pay, contending that Woodall was guilty of arson and misrepresentation. Woodall and his wife then sued the insurance company and the appellant, referring to them as "joint tortfeasors...
