The issues here arise on the complaint of Richard A. Bartl, Receiver in Bankruptcy1, seeking a determination by the Court that a deed of trust conveying to the defendants an interest in real property formerly held by the bankrupt, Philander P. Claxton, III ("Claxton, III") is null and void as fraudulent to creditors.
