This is an action for breach of contract and deceit brought on August 17, 1976, by the plaintiffs, Stephen Kolakowski and Emil Kolakowski, against the defendant, Leigh D. Finney, to which the defendant duly filed an answer. Sometime prior to July 16, 1981, the plaintiffs were allowed to amend the complaint and the defendant filed a timely amended answer.
