This is a civil action in which the Division of Employment Security (hereinafter the division) seeks to be reimbursed by the Town of Mattapoisett (hereinafter the town) for unemployment compensation payments made to a terminated teacher.

The case was submitted to the District Court upon an "agreed statement of facts" amounting to a case stated, so that we need not consider the requests for rulings...
