On December 10, 1979, plaintiff Felix Delgado, an inmate confined at the Waupun Correctional Institution (WCI) in Waupun, Wisconsin, instituted this action by filing a pro se complaint in which he alleged that the practice of "double celling" prisoners at WCI constitutes cruel and unusual punishment in violation of the Eighth Amendment to the United States Constitution.
