OPINION BY JUDGE DOYLE, December 15, 1983:

This is an appeal from a decision made by the Court of Common Pleas of Monroe County which sustained Monroe County's (County) preliminary objections to a petition for the appointment of viewers made by appellants, Para Transit Corporation and Irving S. Karpe (Karpe). Karpe requested the appointment of viewers to assess the damage he suffered as a result of an alleged violation of the Municipal Authorities Act (Act)
