Appellant, Robert Paul Berndt, was tried before a jury and convicted of two counts of first degree murder, A.R.S. § 13-1105, one count of attempted murder, A.R.S. §§ 13-1001, 13-1105, armed robbery, A.R.S. § 13-1904, and kidnapping, A.R.S. § 13-1304.
