The appellant, J.C. Smith, was indicted for unlawfully selling a controlled substance, Pentazocine, in violation of § 20-2-70, Code of Alabama 1975. The jury found him "guilty as charged" and the trial judge sentenced him to 15 years' imprisonment in the penitentiary.
