Plaintiff, Jeannie M. Cupp, the widow of Russell G. Cupp, instituted this suit seeking workers' compensation death benefits. Cupp named Russell's former employer, S & D Construction Company, Inc., and its compensation insurer, Liberty Mutual Insurance Company, as defendants.
