This is a criminal appeal in which the defendant, Johnny Telsee, Jr., challenges his sentence of forty years at hard labor under the forcible rape statute as excessive punishment in violation of Article 1, Section 20 of the 1974 Louisiana Constitution. Twice previously this court considered this case and remanded it to the trial court: first, to resentence the defendant after conducting a presentence hearing, 388 So.2d 747
