PER CURIAM.

Defendant was charged with perjury in a court proceeding, MCL 750.422; MSA 28.664. Defendant moved to quash the information. The people now appeal the trial court's order granting the motion to quash.

The alleged perjury took place in defendant's trial for criminal sexual conduct in the first degree, MCL 750.520b; MSA 28.788(2), which resulted in his acquittal. The alleged crime had occurred on July...
