This is a devolutive appeal from the trial judge's ruling dismissing the State of Louisiana, Department of Transportation and Development (DOTD) from this action in tort for the wrongful death of Ruth Armshaw who died on February 14, 1979 in a one-car accident on U.S. Highway 61 (Airline) in St. James Parish.
