This is a tort action for fraudulent misrepresentation and suppression of a material fact which the defendant was under an obligation to communicate. This cause of action arose out of the sale of an automobile by Village Toyota Company, Inc. (defendant and appellant herein), to the plaintiffs Alesa Mae Stewart and her husband Jesse C. Stewart.
