The petitioner, Samuel Simmons, was found guilty of rape by a jury trial and sentenced to life imprisonment. At trial petitioner was represented by the public defender's office. On direct appeal, Ellen Condon, a public defender was appointed to represent Simmons. Ms. Condon ordered the complete transcript of the trial court proceedings from the clerk of the state court.
