James Eberhardt was indicted by the Hamilton County Grand Jury for third degree burglary, grand larceny, and felonious possession of burglary tools. After a trial by jury, Eberhardt was acquitted on the charge of felonious possession of burglary tools but was convicted of third degree burglary and grand larceny.
