MEMORANDUM OF DECISION

HOLDEN, District Judge.

The grand jury returned an indictment against the defendants on June 29, 1983 charging in Count One a violation of 15 U.S.C. § 11 by conspiring to unreasonably restrain interstate trade and commerce under the Sherman Act. Counts Two and Three charged the defendants with committing mail fraud in violation of 18 U.S.C. § 1341.2
