SHORTESS, Judge.

On October 2, 1981, Morris Patterson (defendant) was charged with violating La.R.S. 40:9661, in that he produced a controlled, dangerous substance, to-wit: marijuana. After trial by jury on May 18, 1982, defendant was found guilty and sentenced to five years at hard labor. He has appealed both his conviction and sentence.
