A jury found this appellant guilty of rape in the first degree as charged in an indictment, substantially in the language of Alabama Criminal Code § 13A-6-61, that he "a male, did engage in sexual intercourse with [the name of the alleged victim], a female, by forcible compulsion." The indictment was returned on May 27, 1980. On that date the Grand Jury returned two other indictments against the same defendant, one for burglary...
