This is an automobile accident case where the trial court ruled that the appellant, the basic reparations obligor on the truck involved, was liable for a passenger's personal injury protection payments.

Appellant refused to pay the personal injury protection payments (PIP) on the grounds that the driver of the truck, appellee William Clem, did not have permission of the truck's owner to drive the vehicle at the time and place of the accident...
