This matter is before the court on plaintiffs' motion for summary judgment.

The plaintiff is a union and alleges that the defendant was a party to a collective bargaining agreement known as the "National Master Freight Agreement and Eastern Conference Iron and Steel Rider and Teamsters Joint Council No. 40 Supplement".
