This suit arose out of a collision on August 26, 1977, between a taxicab driven by Albert Musacchia and an automobile driven by Margaret Elmer. Plaintiff, Joyce Oshinski, who was a passenger in the taxicab, sued the two drivers, their insurers and United Cabs, Inc., as the alleged employer of Musacchia.
